Taxes and DAC7 – what we report about Professionals

Why we ask for this
As a platform operator, we are required to collect data about Professionals and report it once a year to the Head of the National Revenue Administration (KAS). This follows from Division IIIA of the Act on the exchange of tax information with other countries, which implements the EU DAC7 directive. The tax office may pass this data on to other EU countries where the Professional lives.
This applies to every Professional, regardless of the amounts and of whether they run a business. For services there is no amount threshold.
When we ask
With your first Contract, that is, when a Client chooses you for the first time. You do not have to provide anything before that.
What data
- first name and surname, or business name;
- address of residence or registered office;
- PESEL (Polish national ID number) or NIP (tax ID) (and your VAT number, if you have one);
- date of birth;
- register number (for companies);
- bank account number;
- a statement whether you act as an entrepreneur;
- the amounts you earned from Contracts concluded through the Platform in each quarter, and the commission we collected.
We report amounts net: the Contract price minus our commission, in whole zloty, by the quarter of payment, and only for completed Contracts.
What happens to the data
- By 31 January we report the information for the previous year to the Head of KAS (form DPI-IS).
- By 31 January we send you a copy of what we reported about you.
- We keep the data for 5 years from the end of the year in which the reporting deadline passed.
- If there is a security breach involving this data, we will inform you without delay.
What if you do not provide the data
We will remind you twice. If the data is still missing 60 days after the first request, we will suspend the ability to submit Offers until it is completed. This is a statutory requirement (Article 75o), not a penalty – it does not affect your account status.
Does this mean I have to pay tax
Reporting the data does not create a new tax. Your tax obligations on your earnings are the same as they would be without the Platform. If in doubt, ask an accountant or the tax office – we do not give tax advice.
Your rights
You have the right to know what we reported about you, to correct wrong data and to lodge a complaint with the President of UODO (the Polish Data Protection Authority). More in the Privacy Policy.
