What is statutory liability for defects, and how do I use it?
In short It's the contractor's liability for defects in the work under the Polish Civil Code. You report a defect to the professional who did the work, ideally in writing and with photos.
Statutory liability for defects in the work (rękojmia) is your right against the contractor, set out in the Kodeks cywilny (Polish Civil Code). It applies by law, with no extra agreement needed. The time limits and what you can demand depend on the law and on whether the professional is an entrepreneur. Check the details at the source or with a consumer ombudsman.
Entrepreneur or private person
With each offer you can see whether the professional has declared that they are an entrepreneur. If they aren’t, the consumer rights legislation doesn’t cover them, but the Civil Code does.
How to report a defect
- Report it as soon as possible after you notice it.
- Describe what’s wrong and since when. Add photos.
- For a completed contract, use the “File a complaint” button or write through “Help”. The conversation with the professional reopens, and a staff member sees the case.
- Keep the messages, the photos and the sales document, if you have one.
The platform’s role
You paid the professional directly, so a complaint doesn’t move any money through the platform. The platform doesn’t limit your rights against the professional.
